Terms of Service
These Terms govern your use of maia-recruitment.com (the "Site"), operated by MAIA MANAGEMENT S.A.S. ("Maia Recruitment", "we", "us"). By using the Site or submitting an application or brief through it, you accept these Terms.
1. Who can use the Site
You must be at least 18 years old and able to enter into a binding contract under the law of your jurisdiction. The Site is intended for adults exploring legitimate employment relationships.
2. Candidate use
If you submit your information as a candidate, you confirm the information is true, up to date, and yours to share. You consent to Maia Recruitment using that information to evaluate fit for open roles and to contact you. Maia Recruitment never charges candidates a fee for inclusion, evaluation, presentation or placement.
3. Employer use
If you submit a brief or otherwise engage Maia Recruitment as an employer, the specific commercial terms (placement fees, EOR add-ons, replacement guarantees, payment terms) will be set out in a separate signed engagement or order form. Indicative pricing on the Site is for guidance only and does not constitute an offer.
4. Placement guarantee
Unless otherwise stated in a signed engagement, Maia Recruitment offers a 90-day replacement guarantee on direct-hire placements: if a candidate placed by us leaves or is dismissed for cause within 90 days of start, we will source a replacement at no additional fee. The guarantee does not apply to candidates terminated for reasons unrelated to fit (e.g. layoffs, restructuring, role elimination).
5. No guarantee of employment or placement
Use of the Site does not entitle a candidate to be presented to any employer, to receive any offer, or to be hired. Use of the Site does not entitle an employer to be presented any specific candidate. We may decline to work with anyone for any lawful reason.
6. Intellectual property
The Site, including its design, code, content and brand marks, is the property of MAIA MANAGEMENT S.A.S. You may not copy, scrape, frame, mirror or otherwise reproduce the Site without prior written permission, except for ordinary browser caching and normal use.
7. Acceptable use
You agree not to: (i) submit information that is false, misleading or someone else's; (ii) submit content that is unlawful, abusive, harassing, discriminatory or violates third-party rights; (iii) interfere with the Site's operation; (iv) attempt to access non-public areas or data; (v) use the Site to spam other users.
8. Third-party links
The Site links to other Maia Group sites (maia-management.com, maia-marketing.com, maia-legal.com and others) and external services. We are not responsible for the content or practices of any externally-operated service.
9. Disclaimer
The Site is provided "as is". To the maximum extent permitted by Colombian law, Maia Recruitment disclaims all warranties, express or implied, regarding the Site and its content.
10. Limitation of liability
To the maximum extent permitted by law, Maia Recruitment's aggregate liability arising from use of the Site is limited to the amount paid by you to Maia Recruitment in the twelve months preceding the event giving rise to the claim, or COP 1,000,000 if no payment was made.
11. Governing law & jurisdiction
These Terms are governed by the laws of the Republic of Colombia. Disputes arising from these Terms or the Site shall be resolved before the competent courts of Santa Marta, Magdalena, Colombia.
12. Changes
We may update these Terms. The version on this page at the time you use the Site applies to that use. Material changes will be flagged via the "last updated" date.
